Clovis man sentenced for sex with 13-year-old

A 29-year-old Clovis man Friday to six years in prison for having a sexual relationship with a 13-year-old girl, according to a release from the 9th Judicial District Attorney’s Office.

The victim told police about the two and a-half month relationship in 2005, and said she met Joe Garcia in 2005 at a Clovis athletic event and exchanged phone numbers, the release said.

Garcia told police the relationship was consensual and confessed to having sex with the minor, according to the release.

Under state law, a 13-year-old doesn’t have the mental capacity to consent to sex with someone over 17 years old, the release said.

Garcia will have to serve 85 percent of his sentence before he’s eligible for parole and upon release he’ll have to register as a sex offender, the release said.
