Trial of Cannon airman to start

The murder trial of Airman Basic Edward M. Novak for the October 2004 death of his wife, Kimberly S. Novak, in their home on Cannon Air Force Base, is scheduled to begin at 8 a.m. in the Cannon courthouse January 28.

Airman Novak, 712th Maintenance Squadron Provisional, previously the 27th Aircraft Maintenance Squadron, was charged with the murder under Article 118 of the Uniform Code of Military Justice.

A pre-trial investigation held under Article 32 of the Uniform Code of Military Justice concluded there was sufficient cause to believe a crime was committed and Lieutenant General Norman Seip, 12th Air Force Commander, referred the charge to trial.

The charges are merely accusations. Airman Novak is presumed innocent until and unless proven guilty.
